Terms and Conditions

1. Definitions

For purposes of these Terms and Conditions:

• "Application" refers to Datewise - Your AI Dating Assistant, the mobile application provided by the Company for iOS devices.
• "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Max Luong, based in Vietnam.
• "Service" refers to the Application and all features, content, and functionality provided through the Application, including AI-powered dating reply suggestions, conversation analysis, and pickup line generation.
• "Device" means any device that can access the Service such as an iPhone or iPad.
• "You" (also referred to as "User") means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
• "Content" means any images, screenshots, photos, text, or other materials you upload, submit, or transmit through the Service.
• "AI-Generated Content" means any suggestions, replies, pickup lines, or other content generated by the Service's artificial intelligence features.
• "Third-Party Services" means any services or platforms not owned or controlled by the Company, including RevenueCat, Google Gemini API, Apple App Store, and others integrated with the Service.
• "Subscription" means the paid premium features and services available through in-app purchase.

These definitions shall apply regardless of whether they appear in singular or plural.

2. Acceptance of Terms

By accessing, downloading, installing, or using the Application, you acknowledge that:

1. You have read and understood these Terms and Conditions
2. You agree to be bound by these Terms and Conditions
3. You have read and agree to our Privacy Policy
4. You meet the age requirement specified below

If you do not agree to these Terms and Conditions, you must not access or use the Service.

3. Age Requirements and Eligibility

You must be at least 17 years old to use this Application.

By using the Service, you represent and warrant that:

• You are at least 17 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable law

Why 17+?

• The Application provides dating and romantic conversation assistance
• AI-generated content may contain mature or suggestive themes
• The Service is intended for adult dating scenarios
• Using the Service requires mature judgment and discretion

4. AI Service Disclaimer

Important Notice: Datewise DOES NOT provide professional dating advice, relationship counseling, or guaranteed results.

What This Means for You

✅ The Service CAN:

• Analyze conversation screenshots using AI
• Generate reply suggestions based on context
• Provide pickup line ideas with various tones
• Offer conversation starters and icebreakers

❌ The Service CANNOT:

• Guarantee success in your dating conversations
• Replace genuine human connection and authenticity
• Provide professional relationship advice
• Predict how another person will respond
• Account for all personal, cultural, or situational nuances

5. License to Use the Application

Subject to your compliance with these Terms and Conditions, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use.

License Restrictions

You agree NOT to:

• ❌ Copy, modify, or create derivative works of the Application
• ❌ Reverse engineer, decompile, or disassemble the Application
• ❌ Rent, lease, sell, sublicense, or transfer the Application
• ❌ Use the Service for any commercial purpose without authorization
• ❌ Access the Service through automated means (bots, scrapers, etc.)
• ❌ Circumvent any security features or usage limitations

6. User Content and Grant of Rights

You retain all ownership rights to Content you upload to the Service. By uploading Content, you grant the Company a limited, temporary license to process your images and generate AI suggestions.

Important: We do NOT permanently store your uploaded images on our servers. Images are immediately discarded after processing. Google Gemini API retains images for 55 days for abuse monitoring only.

7. Subscriptions and Payments

Available Subscriptions

• Weekly Subscription: $9.99/week with 3-day free trial
• Monthly Subscription: (pricing to be determined)
• Annual Subscription: (pricing to be determined)

All purchases are processed through Apple App Store. We do not directly process payments.

Managing Subscriptions

You can manage and cancel your subscription through your iOS device Settings:

1. Open Settings app
2. Tap your name at the top
3. Tap Subscriptions
4. Select Datewise
5. Tap Cancel Subscription

8. Prohibited Uses

You agree NOT to use the Service for:

• ❌ Illegal content or activities
• ❌ Explicit sexual content or nudity
• ❌ Images of anyone under 18 years old
• ❌ Violence, threats, or harassment
• ❌ Privacy violations or sharing content without consent
• ❌ Spam or commercial use without authorization
• ❌ System abuse, hacking, or automated tools

9. Intellectual Property Rights

All aspects of the Service are protected by intellectual property laws. Datewise and the Datewise logo are trademarks of Max Luong.

11. Privacy and Data Protection

Your privacy is important to us. Please review our complete Privacy Policy for detailed information about how we collect, use, and protect your data.

Summary:

• Most data is stored locally on your device
• Images are NOT permanently stored on our servers
• We comply with GDPR, CCPA, and Vietnam data protection laws

12. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that AI-Generated Content will be accurate, appropriate, or effective. YOU USE THE SERVICE AT YOUR OWN RISK.

13. Limitation of Liability

The Company's total liability shall not exceed the greater of:

1. The amount you paid in the 12 months preceding the claim, OR
2. $100 USD

We are NOT liable for indirect damages, lost profits, data loss, relationship issues, or consequences from using AI suggestions.

14. Indemnification

You agree to indemnify and hold harmless the Company from claims arising from:

• Your use of the Service
• Your Content uploads
• Your violations of these Terms
• Relationship issues from using AI suggestions

15. Termination

We may suspend or terminate your access immediately for violations of these Terms. Upon termination, you must stop using the Service and delete the Application.

Important: Deleting the app does NOT cancel your subscription. Cancel separately in iOS Settings.

16. Governing Law

These Terms shall be governed by the laws of Vietnam. Legal proceedings shall be brought in Vietnamese courts.

Dispute Resolution

Before filing legal action, please contact us at support@tryflirtai.app to attempt informal resolution.

17. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes at least 30 days in advance. Continued use after changes constitutes acceptance.
